These Terms of Use (“Terms”) govern your access to and use of the website located at https://mywellnessmd.com (the “Site”) and any related services, including online contact, appointment scheduling, and telehealth services made available through the Site (collectively, the “Services”).

By accessing or using the Site or Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.

1. About Us

MyWellnessMD is a California-licensed virtual medical practice with in-office locations in Santa Monica, providing telehealth services to patients located in California. Contact: info@mywellnessmd.com.

2. No Medical Advice — Site Content Is Educational Only

The content on this Site — including text, graphics, images, articles, blog posts, and other material — is provided for general informational and educational purposes only. It is not medical advice and is not intended as a substitute for professional medical diagnosis, treatment, or care.

  • Reading content on this Site does not create a physician-patient relationship between you and MyWellnessMD or any of its providers.
  • A physician-patient relationship is established only after you have completed our intake process, provided informed consent, and had an in-person or telehealth visit with a MyWellnessMD provider.
  • Never disregard, delay, or avoid seeking professional medical advice based on something you have read on this Site.

Always consult a qualified licensed healthcare provider with questions about a medical condition or treatment.

3. Medical Emergencies — Call 911

If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. Do not use this Site, contact forms, email, or telehealth services to report a medical emergency. We do not monitor communications 24/7 and cannot provide emergency care through the Site.

4. Telehealth Services

Telehealth services are offered only to patients physically located in California at the time of the visit, consistent with California medical licensure. By using our telehealth services, you acknowledge and agree that:

  • Telehealth involves the use of electronic communications to enable healthcare providers to share individual patient medical information for the purpose of improving patient care.
  • Telehealth has inherent limitations, including that the provider may not be able to fully assess your condition without an in-person examination, and that technology failures (dropped connections, poor audio/video quality) may occur.
  • You are responsible for providing accurate health information and for ensuring you are in a private, safe environment during the visit.
  • The provider may determine, at their discretion, that your condition requires an in-person visit or referral.
  • Telehealth is not appropriate for medical emergencies.
  • Separate written informed consent for telehealth will be obtained before your first telehealth visit as required by California law.

5. Appointment Requests and Communications

Requests submitted through contact forms, email, or scheduling tools on the Site are not confirmed until a member of our team responds to you directly. Please do not include sensitive health information in general contact forms or unencrypted email. Established patients should use the secure patient portal for all clinical communications.

6. User Conduct

When using the Site, you agree that you will not:

  • Use the Site for any unlawful purpose or in violation of any applicable law or regulation
  • Attempt to gain unauthorized access to any portion of the Site, our systems, or other users’ information
  • Interfere with or disrupt the Site or its underlying infrastructure (including introducing viruses, malware, or excessive automated traffic)

This disclaimer does not apply to the professional medical services provided by our licensed providers to patients, which are governed by the applicable standard of care and provider-patient agreements.

Nothing in these Terms limits liability for:

  • Professional medical negligence by our licensed providers
  • Fraud or willful misconduct
  • Any liability that cannot be limited under applicable law

12. Indemnification

You agree to defend, indemnify, and hold harmless MyWellnessMD and its providers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Site in violation of these Terms; (b) your violation of any law or third-party right; or (c) content you submit through the Site.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any legal action or proceeding arising out of or related to these Terms or the Site (excluding claims for professional medical services, which are governed by California medical malpractice law) shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

14. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (including Sections 7, 10, 11, 12, and 13) will survive.

15. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date at the top will reflect the most recent revision. Material changes will be communicated by posting notice on the Site. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in full force and effect.

These Terms, together with the Privacy Policy and any additional patient agreements or informed consents, constitute the entire agreement between you and MyWellnessMD regarding your use of the Site.
